Week 3 Discussion – The Extent of the Bill of Rights
Protection of individuals from the government is spelled out in the Bill of Rights within the Constitution. Review the Bill of Rights (the first 10 amendments), and choose one of the amendments you feel very positive about.
In the discussion, share the amendment you selected and what makes this amendment such a good one. Then share some thoughts on whether or not the individual protection this amendment provides could infringe on another’s individual rights. For example, could your freedom of speech actually create a less free situation for someone else? Why or why not? Provide rationale and examples to support your response.
WEEK 4
Week 4 Discussion – Court-Packing
As you read in your textbook, “court-packing” is not a new concept. Roosevelt first proposed it in the 1930s. But in recent years similar suggestions or ideas have surfaced, such as those referenced in the article you read to prepare for this discussion.
Share your opinion on “court-packing” or any similar adjustments to the Supreme Court.
Are you open to the idea under certain circumstances? If so, what would those be?
If you’re not open to it, is there any scenario in which you might be open to it?
Provide rationale and support from this week’s readings to back up your opinions.
WEEK 5
Week 5 Discussion – Quick, Efficient, or Democratic?
You have likely seen that when it comes to legislation at the top of the federal government, a bill can become a law fairly quickly. However, the time it takes for that law to be implemented is often a much longer period of time. Part of this is because it is up to the agencies to interpret and implement the law (discretion) as they see fit, and that can often take much longer.
If you had the ability to change this process, would you? Why or why not? Be specific about what you would change or why you wouldn’t make changes. Include real examples to support your position.
Week6
Respond to this discussion using the Supreme Court Case on Department of Homeland Security v. Regents of the University of California Links to an external site., which you read in the discussion preparation.
At Issue:
Whether the Department of Homeland Security’s decision to wind down the Deferred Action for Childhood Arrivals (DACA) policy is judicially reviewable, and whether DHS’s decision to wind down the DACA policy is lawful.
Finding:
The Department of Homeland Security’s decision to wind down DACA is reviewable, and its decision is in violation of the Administrative Procedure Act (APA).
After reading the complete case, do you agree or disagree with the Court’s ruling? Why?
What argument(s) would you have used to convince the Court to come to an opposite conclusion? Provide rationale and support from course readings for your answer.
